As a Freelance Quantity Surveyor, setting up construction agreements is one of the most important aspects of my job. The agreement we offer for free is a contract for a contractor to a sub-contractor but it could equally be used by a home owner for a domestic house extension, it's that flexible.

Construction Agreement

Case Study

Doors are us have decided to accept an offer from one of their labour only sub-contractor door fixers. The quote received from their sub-contractor is not detailed at all and just say's "£2500 for works as agreed."

Now at the time you may think that the quote is fine and was a fair price for the scope of works you discussed on the telephone. But what happens in the future if there is a disagreement? Lets say your sub-contractor thinks he should be paid more money as the work has taken him longer than expected. How would you prove that he quoted let's say £100 per door and would install 25 doors at this rate. The truth is you can't. So you have a problem and could have to pay more money to the sub-contractor as you can't prove the original agreement.

The easiest action is to compile a contractor agreement from the beginning. So in this instance you would want to add to the contractor agreement the following:

The site address

The contractors full details including address

The drawings and/or documentation you gave to the sub-contractor for pricing

The cost per door for labour only

The construction time allowance to complete the works

The payment terms

The retention percentage

Any insurance requirements

Your terms and conditions of business

The above list is not inclusive but it gives you an idea of the sorts of items you should be documenting to protect your business.
